General

How many employees do you have?

Just one—our founder. Everyone else on the Banner Day team is a fellow entrepreneur or independent collaborator who runs their own successful business and partners with us to deliver our best collective work to you. We operate as a “flash team” which, while not quite as provocative as it might sound, is a really smart, efficient, and client-focused way to run a branding company. It means we hand select, vet, and onboard the people we would (and do) trust with our own brands and then engage them to create yours. Because they’re already loyal members of the Banner Day team, and because we work on a set project calendar (see Do you do rush projects? below), there’s no scrambling to staff your project or mismatching your needs to our talent. We believe this model represents creative collaboration at its finest.

How long will my project take?

Here are some general estimates. We’ll confirm or customize timing for your project during our proposal process. As with any collaboration, adding additional or extended rounds of feedback, revisions, scope changes, etc. will add to the total timeline.

  • From contract and payment to first collaboration session: Expect around two to four weeks. We build in this time for onboarding and pre-work, including your branding or naming questionnaire.
  • For full branding or rebranding projects with messaging, design, and activation: Expect about ten to twelve weeks. Our signature package includes everything from defining your brand in words, to logo and visual identity design, to your choice of ready-to-share branded assets. And that’s before we get to your month of built-in launch support.
  • For full naming or renaming projects: Expect about six to eight weeks from project start to final name selection. Once you've chosen the finalist names to submit for your legal trademark clearance searches, expect to spend around two weeks receiving results, making a decision, and working with Vivid IP to prepare and submit your trademark application. The longest part of naming begins after that trademark application is submitted and it’s up to the trademarking agency to review and process your application and registration. According to the USPTO, "The total time for an application to be processed may be anywhere from almost a year to several years." Vivid IP will advise you on when and how to start using your chosen name.
  • For Name Checks and naming consultations: Expect two to three weeks from the start of your engagement to your recommendations review. See above for Vivid IP's legal services timelines.
  • Do you do rush projects?

They’re the exception to our rule. We follow a “book-don’t-overbook” policy at Banner Day, which means we reserve work in advance according to a set calendar of availability. This way, every project and every client gets our focused time and attention. We also build in time for onboarding and pre-work to prep projects for success and keep them running smoothly from start to finish (see How long will my project take? above). If we have the availability on our calendar, we can expedite and rush projects—to a reasonable degree, for a reasonable fee.

Do you work with larger companies, too?

Our focus and purpose at Banner Day is to serve entrepreneurs, startups, and smaller businesses—especially those who are often overlooked or undervalued by larger, more traditional agencies. We’re also a team of independent collaborators who are open to all kinds of opportunities. Have one in mind? Let’s talk!

Can I purchase services à la carte vs. as a package?

Ours is more of a prix fixe menu—preset, precisely coordinated, and personalizable to your unique tastes. The Banner Day team (your fellow entrepreneurs) designs our packages to deliver big-impact branding for the specific needs and challenges of smaller businesses. From what’s included, to what you can add on, to what you’ll get out of every engagement, we build packages that will take your brand exactly where it needs to go in order to measurably grow your reputation and your business. And because serving you means more than dollars-and-cents to us, you’ll always get the best value we can offer. (And few can match.)

What if I have a really small budget?

We’ve been there. Most small businesses start as even smaller ones. When you request our packaging and pricing list, we’ll ask you to tell us about your branding and marketing budget. From there, we’ll recommend packages and even refer you to freelancers, solopreneurs, and other super-small-but-mighty businesses in our network. Because we've already designed our packages to offer the best-possible balance of investment in and value out for our fellow entrepreneurs, we rarely discount our pricing. (Exceptions include combination pricing when booking certain engagements together and referral rewards as part of our partnerships program.)

Do you do [something not listed in Our Services]?

We believe in doing a few things extraordinarily well, versus doing many things well enough. That said, as a company of independent collaborators, the Banner Day team has many, many talents. (And many, many talented colleagues.) Let us know what you’re looking for and we’ll see how we can help.

    What’s INVINCIBLE INC.?

INVINCIBLE INC. is our sister brand. Created in partnership with the intellectual property law experts at Vivid IP, it's how we offer you not only all-in-one creative and legal branding services, but also tag-teamed workshops, webinars, speaking events, and other educational offerings to help you better create, grow, and protect your brand. That said, Banner Day and INVINCIBLE INC. are not law firms. (Vivid IP is one of the best.) Learn more in the Trademark Clearance & Registration section of our Q&A, below.

Like creative naming and logo design with federal trademark and copyright protection—a pretty unbeatable combo, if we do say so ourselves.

    Branding

Will you work with the designer/web developer/copywriter, etc. of my choice?

We’re here to help you translate your business into a brand worth celebrating. If you have someone on your team who can help us do that, we’re absolutely open to collaborating. Let us know what you have in mind during your consultation call and we’ll customize your project accordingly.

Who created the Banner Day brand identity?

Our founder created our brand strategy and messaging and our original collaborator, Russell Shaw, designed the logo, visual branding, and this website. You can see more in the Banner Day brandbook, available in our Library.

    Naming

Do I get to keep all of the names Banner Day generates for my project?

Unless we’ve customized your package and pricing to include naming more than one brand, product, service, etc., you’ll receive exclusive ownership rights to your chosen name only. Under the terms of our Services Agreements, that one finalist name (as well as any presented versions of that finalist name) becomes your exclusive intellectual property as a “work made for hire” under the Copyright Act of 1976. If you decide you’d like to purchase additional names we’ve generated—or, if you’d like to start with a multiple-name engagement—we’ll create a custom quote for you.

    Who named Banner Day?

Our founder, using the same creative and strategic philosophies, processes, and tools we’ll use to name your brand. Our partners, Vivid IP, provided the legal services that ultimately secured our trademark on the Principal Registrar (registration no. 6,302,522 of the US Patent and Trademark Office). They now provide exclusive, built-in legal services for Banner Day naming packages through our INVINCIBLE INC. partnership.

    Trademark Clearance & Registration

Does Banner Day provide legal services?

No. We’re not lawyers and do not offer, provide, sell or accept payment for legal services. For more information, please read the fine print.

What legal trademark and copyright services are available through your partnership with Vivid IP?

When it comes to naming and branding, creative agencies and legal firms don’t traditionally work hand-in-hand. Since both Banner Day and Vivid IP are anything but traditional—and we’re all about helping our clients create strong, standout brands—we’ve partnered together as INVINCIBLE INC. to deliver a seamless experience for our mutual clients. When you choose Banner Day for your naming or branding project, you’ll get built-in access to exclusively packaged and priced legal trademark, copyright, and advising services from Vivid IP. From mark clearance and recommendations, to trademark application through registration, to copyrighting services and beyond, Vivid IP offers everything you need to legally protect your brand. Working closely together throughout your project creates a smoother, faster path to your most meaningful, ownable brand marks. It also allows us to share that combined time and resource savings with you. The result is an all-in-one naming and trademarking project powered by a one-of-a-kind partnership at a value that’s second-to-none. Request our packaging and pricing list for more on our branding and naming offerings, including built-in and add-on legal services from Vivid IP.

Can you guarantee a successful trademark registration for a chosen name?

Ultimately, that’s up to the U.S. Patent and Trademark Office (or other government trademarking agency) and the attorney/s they assign to review your application. It’s similar to how a judge would decide certain court cases. What we can do is dramatically increase your chances for success by ensuring the name you choose is highly unique and thoroughly vetted both by Banner Day’s creative experts and Vivid IP’s legal ones. In other words, you’ll have naming and trademarking professionals working seamlessly together—as INVINCIBLE INC.—to create the strongest possible case for approving your chosen name as your registered trademark. And when you invest in a full naming + trademarking package with INVINCIBLE INC., you also get our Partnership Promise: To keep working with you—at no additional cost—until you receive a registered trademark for your brand.

If, in the unlikely event that the first trademark application attempt doesn't succeed, or the selected mark becomes too risky to pursue, we'll repeat our collaborative process at no extra cost to you until an alternative mark is registered. Vivid IP does not cover defenses to oppositions, appeals, or disputes in these services. However, our extensive clearance process is designed to significantly reduce these actions.
