Workshop Terms & Conditions

The following terms and conditions apply to all workshops and educational sessions (the “workshops”), whether online, in-person, or hybrid, presented by Banner Day / INVINCIBLE INC., and/or our team members and subject matter experts (“we” “us” “our”). Throughout these terms and conditions, you and Banner Day/INVINCIBLE INC. are collectively referred to as the “Parties.”

Please read these terms and conditions before registering for each workshop. By registering for any workshop, whether via Calendly, another online scheduling platform, or any other method, you affirm you have read, understood, and agree to abide by the following terms and conditions.

communication

By registering for a workshop, you agree to receive communications about the workshop from Banner Day, INVINCIBLE INC., Calendly, and/or other representatives who help us operate, maintain, and deliver workshop offerings.

You may be required to share personal information about yourself in order to register and complete your workshop, such as names, company names, and email addresses. In sharing this information, you agree that we may use it for the express purpose of planning and delivering the workshop/s. All personal information collected in relation to the workshop/s will be subject to Banner Day’s Privacy Policy or INVINCIBLE INC.’s Privacy Policy (as applicable).

services

We agree to provide workshops, training, talks, and other eligible educational offerings and services at our sole discretion, as defined by Banner Day / INVINCIBLE INC. leadership and in collaboration with select partners.

no legal advice intended

Banner Day and INVINCIBLE INC. are not law firms. We do not act as your attorney nor as substitutes for advice from an attorney. As non-law-firms, we cannot and do not offer, provide, bill for, nor accept payment for any legal advice or services. None of the information provided herein, in the workshops, or in any document or communication created by or on behalf of Banner Day / INVINCIBLE INC. is intended to, nor does it, constitute legal advice. All such information, content, and materials are made available for general informational and educational purposes only.

relationship

No interaction or communication between you and Banner Day / INVINCIBLE INC. shall be deemed to constitute either Party a partner, joint venturer, or employee of the other Party for any purpose. You agree not to treat us, our team members, or our subject matter experts as such in any way or for any reason.

indemnification

You agree that Banner Day / INVINCIBLE INC. will have no liability and that you will indemnify and hold us harmless for any claim, action, liability, loss, injury, or damage to you or any other person or entity due, in whole or in part, directly or indirectly, to workshop participation.

modification

We reserve the right to change how we manage registrations and deliver workshop offerings, or end certain offerings, at any time without prior notice. We likewise reserve the right to modify terms, conditions, rules, requirements, and methods through which registrations are managed and workshops are delivered. Finally, we reserve the right to disqualify any individual from participating in the workshop/s at any time if they do not comply with these terms and conditions.

payment policies

You agree to pay Banner Day / INVINCIBLE INC. according to the following terms. You further agree that the purchase of the workshop offerings described herein constitutes doing business in the State of Georgia and hereby submit yourself to the jurisdiction of the State of Georgia in all matters relating to the workshop/s.

  • Payments must be made at the time of registration using the provided payment processing platform/s to reserve your spot in the workshop/s

  • Cancellations made up to 30 days before the workshop date will be fully refunded

  • Cancellations made up to 24 hours before the workshop date will be refunded 50% of the total registration fee

  • No-shows and cancellations made within 24 hours before the workshop date will be responsible for 100% of the total registration fee

  • Should Banner Day / INVINCIBLE INC. need to reschedule a workshop for any reason we will notify you promptly; Should you be unable to attend the rescheduled workshop, we will issue your choice of EITHER a credit in the amount of your total, paid workshop fee plus 50% off a future workshop (valid for one full year), OR a full refund of your total, paid workshop fee

  • Should Banner Day / INVINCIBLE INC. need to cancel a workshop for any reason we will notify you promptly and fully refund your registration fee

  • We may choose to offer discounts or otherwise offer special workshop pricing to you at any time, at our sole discretion

Notice of Recording & Participant Release

By registering for or attending any in-person, online/virtual, or hybrid workshop offering by Banner Day / INVINCIBLE INC., you:

  • Acknowledge that we may record photography, audio, and/or video footage of the workshop

  • Consent to be photographed, filmed, or otherwise recorded

  • Consent to the release, publication, and reproduction of any and all recorded media of your image, voice, and/or name for educational, marketing, or other business-related purposes in perpetuity in connection with Banner Day / INVINCIBLE INC., including, by way of example only, use in future educational content, websites, social media, print and digital marketing, promotions, and advertising

  • Waive and release any claims you may have related to the use of recorded media at the workshop/s, including, without limitation, any right to inspect or approve the photo, video, or audio recording, any claims for invasion of privacy, violation of the right of publicity, defamation, and copyright infringement, or for any fees for use of such recorded media

  • Acknowledge that all photography, filming, and/or recording will be done in good faith and in reliance on your consent as provided under the aforementioned terms and conditions

If you do NOT consent to the recording and use of recorded footage as described in this notice and release agreement, you may choose to withhold your consent by NOT registering for the workshop/s OR withdraw your consent by NOT attending the workshop/s.

Because you are required to read these terms and conditions in their entirety before registering for the workshop/s, AND affirm you have read, understood, and agree to abide by these terms and conditions upon registration, no refunds will be given in the event you choose to withdraw your consent by not attending the workshop/s for which you have previously registered.
